The problem with Cymbalta (duloxetine) is that it has been associated with a number of serious side effects, including withdrawal disorders (“brain zaps”), birth defects, suicidal behavior, and more. Its manufacturer, Eli Lilly & Co., is facing numerous lawsuits, including a Cymbalta class action lawsuit, for misleading patients about these risks.

What is Cymbalta?
Cymbalta (duloxetine) is a popular antidepressant in the SNRI (serotonin-norepinephrine reuptake inhibitor) class. It is manufactured by Eli Lilly & Co. and it has been on the market since 2004. Cymbalta is a blockbuster drug that generated an estimated $18 billion by 2011.
Eli Lilly Settles Cymbalta Suicide Lawsuit
In April 2013, Eli Lilly & Co. settled a long-running Cymbalta suicide lawsuit filed by the parents of Peter Schilf, a 16 year-old boy who killed himself in 2004 after taking samples of Cymbalta for four weeks. His family physician testified that he never would have given the boy Cymbalta if he had known about the risk of suicide. Eli Lilly failed to disclose several suicides that occurred during clinical trials of Cymbalta. The FDA required a Black Box warning about the risk of suicide from Cymbalta in 2005.
Cymbalta Class Action Lawsuit Filed for Withdrawal Disorders
Eli Lilly & Co. is facing a Cymbalta class action lawsuit for engaging in deceptive and unlawful marketing practices to mislead patients and doctors about the frequency, severity, and duration of withdrawal symptoms. These symptoms include “brain zaps,” dizziness, nausea, fatigue, nightmares, hallucinations, anxiety, insomnia, suicidal behavior, headaches, and more. The class action was filed in the U.S. District Court for the Central District of California in Los Angeles.
Cymbalta Birth Defects
Cymbalta is a Pregnancy Category C drug, meaning that it could potentially cause a birth defect, but doctors can still prescribe Cymbalta to pregnant women if the benefits outweigh the risks. Unfortunately, there is a growing amount of evidence linking Cymbalta and other antidepressants to an increased risk of birth defects.
Cymbalta birth defects may include:
- Heart defects
- Atrial Septal Defect
- Ventricular Septal Defect (VSD)
- Tetralogy of Fallot
- Transposition of the Great Arteries
- Truncus Arteriosus
- Persistent Pulmonary Hypertension of the Newborn (PPHN)
- Neural tube defects
- Spina bifida
- Pulmonary Atresia
- Diaphragmatic Hernia
- Neonatal withdrawal syndrome
- And more
About Class Action Lawsuits
Class action lawsuits make sense when a large number of people have very similar legal claims against the same defendant, especially when it would be financially impractical for one plaintiff to file a lawsuit alone. The “class representative” files a lawsuit, and plaintiffs who join the lawsuit consolidate their legal claims into one claim.
Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Cymbalta Class Action Lawsuit
Schmidt & Clark, LLP is nationally recognized as a class action law firm. However, our lawyers filing individual lawsuits as opposed to a Cymbalta class action lawsuit. Although class actions offer advantages in certain circumstances, they can also have serious disadvantages for plaintiffs who are very seriously injured.
Most plaintiffs in a class action are represented by a “class representative,” and only the representative’s case goes to trial. Cymbalta injuries are extremely serious, and we believe each of our clients deserves the opportunity to present his or her case before a judge and jury. Plaintiffs in a class action may also be forced to accept a “low-ball settlement” and high attorneys’ fees.
At Schmidt & Clark, LLP, we understand that many of our clients are suffering extremely serious damage to their physical, emotional, and financial health. We file individual Cymbalta lawsuits so we can provide individualized legal representation and fight for maximum compensation in every case.
